Developer fined for selling 'illegal' plots

The district consumer disputes redressal forum, SAS Nagar, directed a developer to pay `50,000 each as compensation to two consumers for selling plots which were declared “illegal” by Greater Mohali Area Development Authority (GMADA).
The consumer forum, on June 18, while disposing of two separate complaints, held Sky Rock Welfare Society, Sector 70, SAS Nagar, deficient in services.

As none appeared on behalf of the developer, despite service of summons, they were proceed ex parte.
“The developer has deliberately not appeared before the forum. The act of the developer is nothing but an act of deficiency in service and its non-appearance only shows that it has nothing to say.”

OP Mittal, a resident of Sector 48-C, Pushpac Complex, Chandigarh, had booked a plot in Mullanpur with Sky Rock Welfare Society, SAS Nagar, after paying `2.5 lakh.

Similarly, Surinder Kaur, a resident of Sector 65, SAS Nagar, had bought the plot in Mullanpur after paying the booking amount of `4.85 lakh.

The GMADA has declared the society as illegal and cancelled its developers and promoters license, following which they sought refund which was not done by the developer.

Apart from getting compensation, both Mittal and Surinder are entitled to get refunds of `2.5 lakh and `4.85 lakh, respectively, along with 9% interests.
