For failing to hand over possession of flat and later refund money deposited by the customer, district consumer disputes redressal forum, SAS Nagar, has directed the developer to pay `20,000 as compensation for deficient services.
Disposing of the complaint filed by Robin Khera and his wife Shikha Kataria, a resident of Sector 42, the consumer forum also directed Sky Lark Urban Development Private Limited to refund `6.85 lakh with 12% interest.
Khera and his wife had applied for a residential flat in April 2012 and as per the terms and conditions of booking, the construction of the unit was to be completed and offered for possession within 18 to 24 months from the date of allotment but there was no development on the land. Thereafter, the couple sought for refund but the developer failed to provide the same.
As none appeared on behalf of the developer, they were proceeded ex parte.
The consumer forum presided over by Madhu P Singh on October 30 said that since the developer has chosen not to contest the complaint despite service, negative inference has to be drawn against it and the complaint deserves to be allowed.
