Diesel, Fossil to pay for not refunding price of malfunctioning watch

The district consumer disputes redressal forum has asked a city-based showroom to pay Rs 2,000 as compensation for failing to repair a wrist watch, along with refunding Rs 4,995 - the price of the watch - and Rs 5,000 cost of litigation to a Sector-43 resident.

The district consumer disputes redressal forum has asked a city-based showroom to pay `2,000 as compensation for failing to repair a wrist watch, along with refunding Rs 4,995 - the price of the watch - and Rs 5,000 cost of litigation to a Sector-43 resident.


Ravinderjit Singh had moved the consumer forum against Bangalore-based Fossil India Private Limited and Diesel Fashion India Reliance Private Limited alleging deficiency in services.

Singh submitted that he purchased a Diesel watch, having warranty of two years, from Diesel Fashion India Reliance Private Limited at Elante Mall in September 2013.

He claimed that after using the watch for some days, he realised that there was some defect in its movement, therefore he approached Diesel Fashion India Reliance Private Limited for repair or change of the watch in October. The watch was repaired and returned to him after two weeks.

However, Singh said he still noticed the same defect and the same exercise was repeated. When no permanent solution was found, he requested Diesel Fashion India Reliance Private Limited to replace the watch as it was still under warranty.

Denying any deficiency in service, Diesel Fashion India Reliance Private Limited claimed that the watch was retained in the store for checking on the request of the complainant and sent to Fossil India Private Limited for repair.

They claimed that for the customer's satisfaction, they decided to replace it with a new one, but it was never committed that it would be of the same price and model. As the watch of same model was not available, therefore, on February 8, 2014, they offered the complainant to pick any higher model and pay the difference amount.

Fossil India Private Limited, was proceeded ex parte.

Consumer forum presided over by Rajan Dewan said, “If the watch of same model or of the same price range was not available and if the complainant was not ready to purchase the higher model (which according to him was in the range of Rs 7,000 and above), they should have refunded the amount of the watch to the complainant.

The opposite parties instead of doing the needful chose to sit over the matter and thereby caused
undue harassment to the complainant. Hence, Fossil India Private Limited and Diesel Fashion India Reliance Private Limited are found to be deficient in rendering proper service to this extent.”
