Nearly a month after the central human development resource ministry sanctioned 1,100 teaching posts in the city, the UT education department continues to sit on amendments to teacher recruitment rules which is mandatory to begin the recruitment process.
The issue, pending since 2011, has gained particular significance after the centre sanctioned 1,150 teaching as well as non-teaching posts in March , Right to Education Act, 2009.
While the department maintains that the process will begin after the Lok Sabha elections, the department cannot go ahead with the recruitment without making necessary amendments in its rules that was necessitated after the Right to Education Act, 2009.
According to the act , UT will have to notify the amendments in its recruitment rulers as per the guidelines issued by National Council for Teachers Education (NCTE) before recruitment.?
One of the important eligibility rules, which UT has yet not adopted in its recuirtment rules, is that every state is mandated to recruit teachers only on the basis of the teacher eligibility test (TET) conducted by it.
While states like Punjab and Haryana conducts their own TET, Chandigarh, being UT, is required to consider Central Teachers Eligibility Test (CTET), conducted by Central Board of Secondary Education, as part its eligibility rules.
PREVIOUS ATTEMPT TO SUBVERT THE RULE
In 2012, the UT education department tried to subvert NCTE guidelines while recruiting 800 contractual Sarva Shiksha Abhiyan teachers.
Flouting the norms, it invited applications from candidates wh o h ave passed teachers eligibility test of Punjab and Haryana, besides those who cleared the CTET, and recruited nearly.
After nearly CTET 53 candidates challenged the recruitment process in the Punjab and Haryana high court, the UT administration was forced to withdraw the advertisement on July 17, 2012 and issue a fresh notification with only CTET as main eligibility criteria.
Sources said that the education de par tment had then recruited 800 SSA teachers under the NCTE guidelines on the basis of its draft notification and promised that the recruitment rules would also soon be amended keeping in view the NCTE guidelines.
While the department initiated the process, a final notification, which requires the approval of the department as well as UT administrator, is still awaited.
Experts said that the department is also required to forward the amended rules to the central gover nment for its approval before it is implemented.
While DPI (s) Kamlesh Kumar could not be contacted on t he issue and Deputy Director (School education) Chanchal Singh said that the amendment was under consideration, sources claimed that file is stuck between personnel branch and education department.
