Entire selection should be quashed if there are irregularities: HC

The Punjab and Haryana high court has ordered that if there are irregularities in some selection process, the entire selection should be done away with rather than just the waiting list.

The order came from the court headed by justice Mahesh Grover while disapproving the Punjab government’s submission that since the state vigilance bureau had found irregularities in the 2011-selection process of school vocational master (electrical), the government had decided to cancel the entire waiting list.

“If there were irregularities in the selection, the entire selection should have gone and not only the waiting list,” justice Grover said.

After the result was out, all candidates in the merit list were appointed but later some complaints of irregularities were received which were referred to the state vigilance department and the state government had decided to do away with the entire waiting list, including the petitioner. However, granting relief to the petitioner, Paramjit Singh, the court ordered the state government to ensure his appointment, but without any monetary consequences, with effect from the date when the original appointees were given the appointment. The petitioner had applied for recruitment as vocational master (electrical) under the freedom fighters’ quota against which only one seat was reserved.

The petitioner was placed at serial number one in the waiting list, while one Anil Kumar who was selected did not join. The petitioner had thus pleaded that the vacancy having not been consumed, he should have been given appointment being at first number in the waiting list. The government, however, took the plea the post cannot be given to the petitioner as the vigilance department had found irregularities in the selection.
