Finally, HUDA seals resto-bar 5 Degrees

Finally, Haryana Urban Development Authority (HUDA) on Friday sealed the 5 Degrees restaurant running illegally from the Nirjhar Vatika, Sector 5, here.

The issue had come to light when head constable Jaipal Singh, deployed in security of son of Punjab IAS officer KBS Sidhu, had accidentally shot himself with his service gun while coming out of a New Year Eve party.

HUDA then got inspected the file and found that 5 Degrees had won the bid but no formal agreement had been signed yet.

Estate officer Vandana Disodia had issued a notice to restaurant on January 6 and restrained them from carrying out further operations. A mention of story published in Hindustan Times was also made in the notice.

Sandeep Chauhan, authorised signatory of M/s Hot Beans, appeared before Disodia with his explanation on Friday 10.30 am.

Disodia in her order pointed out, "...it has been admitted that the licensee has taken possession of cafeteria on December 12, 2013, without execution of agreement on the basis of verbal consent of HUDA authorities, however no specific person or authority has been mentioned who gave such verbal consent/ permission. Moreover, no documentary proof in this regard has been submitted with the reply thus there are clear violations of condition no. 4 of the allotment letter."

Regarding serving of liquor on the premises, the order mentioned a letter from the deputy excise and taxation officer dated January 9 said that no licence had been issued to the occupant of cafeteria in Nirjhar Vatika and a public notice was pasted at the site that if any kind of liquor was served pm the said premises it would be an offence and strict legal action would be taken under the excise act.

Regarding alteration, Chauhan admitted that the POP work, ceiling work or portion of brick wall, glass work were part of the renovations. Disodia in her order said, "...Thus he has admitted that he had carried out addition alteration on the premises without prior written permission from HUDA thereby violating condition number 20 of the licence."

Disodia ordered, "...M/s Hot Beans Panchkula and all its staff and personnel should be evicted from the said premises with immediate effect and the said premises be sealed till further order."

Cop's statement yet to be recorded

The police were yet to record the statement of Jaipal Singh. Currently, he is out of danger and soon his statement could be recorded.
