The Punjab and Haryana high court, while disposing of a petition filed by Haryana health minister Rao Narender Singh, Ratia MLA Jarnail Singh, Barwala MLA Ram Niwas Ghorella and Uklana MLA Naresh Selwal, has directed the Haryana Lokayukta to first decide about his jurisdiction to hear the case against them and thereafter pass any order in the case.
The directions came on Wednesday while disposing of the petition filed by the four legislators, challenging the proceedings before the Haryana Lokayukta in the graft compact disc (CD) case purportedly showing them making alleged negotiations with some persons for getting change of land use (CLU) permissions for agricultural land.
The petitioner legislators had approached the high court pleading that the allegations that they sought money in lieu of getting CLU permissions for some land were baseless and the complaint was not maintainable by the Lokayukta under Section 9 of the Haryana Lokayukta Act.
However, the petition filed by chief parliamentary secretary Vinod Bhayana, who had also approached the high court on the same grounds, is pending in the high court. The Indian National Lok Dal had released some CDs in September last year, purportedly showing Haryana Congress legislators allegedly seeking illegal gratification in lieu of getting CLU permissions from the state government to some persons.
