HC admits EX-NCB official Saji Mohan’s plea against sentence

Former zonal director of the Narcotics Control Bureau (NCB), Chandigarh, Saji Mohan on Thursday approached the Punjab and Haryana high court challenging the Chandigarh district court’s five-year sentence awarded to him for criminal breach of trust and misappropriation of Rs 13.85 lakh seized in drug busts.

Taking up his petition, justice Anita Chaudhry admitted his petition for hearing as per its turn and stayed recovery of Rs 20,000 fine imposed on him by the trial court.

In his petition, former Jammu and Kashmir-cadre IPS officer, Mohan informed the court that the trial court had misread the evidence and relied upon the fabricated and forged documents regarding embezzlement of Rs 13.85 lakh.

He submitted that the registration of embezzlement case was an after -thought as when the case was registered he was already in the custody of Mumbai AntiTerrorism Squad in a Narcotic Drugs and Psychotropic Substances (NDPS) case.

Chandigarh police had booked Mohan along with Balwinder, former NCB superintendent, on January 30, 2009. Balwinder had handed over Rs 13.85 lakh amount of a case property to Mohan on December 22, 2008, for depositing it in the bank.

However, Mohan fail ed to deposit the amount. The embezzlement came to fore after Mohan’s ar rest by Mumbai ATS with 12-kg heroin.

After an inter inquiry by the NCB in Chandigarh and a police case was registered on a complaint by the NCB’s malkhana (store room) in - charge RC Bodh. Thereafter receipt and the noting sheet of the money were seized during NCB’s inquiry.
