The Punjab and Haryana high court has issued notice of motion to the Haryana government as well as Central Bureau of Investigation on an application filed by former DGP Haryana SPS Rathore for reconstruction of around 123 pages of the original judicial file of 2001 in Ruchika Girhotra molestation case.
Rathore stated that he inspected the original petition filed in 2001, on March 18 and found that pages 29-152 were missing. It was also informed that the written statements of the complainant Madhu Prakash along with the affidavit of Ashu Girhotra, Ruchika’s brother, were also not available in the original file.
The availability of the aforesaid documents was necessary for the proper adjudication of the case, mentioned Rathore.
Earlier on the request of Rathore, the high court had directed to attach the original file of the case with the petition filed by him for quashing of FIR in abetement to suicide case registered by CBI in January 2010 at police station Panchkula. This case would come up for hearing on March 24.
Rathore had been granted bail by the Supreme Court on November 11 last year, after spending close to six months in Burail jail while serving sentence of 18 months for molesting Ruchika, a 14-year-old budding tennis player in 1990. Later Ruchika had committed suicide.
