Taking up a petition filed by Punjab Congress leader Sukhpal Singh Khaira and 12 other Congress workers seeking quashing of an FIR registered against them at police station Bholath in October 2008 for obstructing a public servant in discharge of public functions, the Punjab and Haryana high court has issued notice of motion to the Punjab government.
The petition came up for hearing before the court headed by justice Surinder Gupta on Wednesday that issued notices to the government for filing its reply by October 7.
The petitioners have also sought quashing of the subsequent legal proceedings against them.
The petitioners have made chief minister Parkash Singh Badal, deputy chief minister Sukhbir Singh Badal and Bholath MLA Bibi Jagir Kaur as respondents in their petition.
The court was informed that the chief judicial magistrate, Kapurthala, had taken the cognisance of the alleged offence and issued summons to the accused vide order dated August 30, 2013.
Appearing for the petitioners, advocate Surjit Singh Swaich submitted that the present case is one of the many frivolous cases registered against Khaira at the behest of the chief minister, deputy chief minister and Bibi Jagir Kaur due to bitter political tussle and animosity to wreak political vengeance on him.
