For failing to provide the promised results under a slimming programme, a Sector-8 fitness centre has been penalised by the district consumer disputes redressal forum after a girl, who was promised reduction of weight within three days, had moved the forum.
Taking cognizance of the complaint of a Sector-22 resident, Anuradha, who alleged Health Sanctuary, a fitness centre, for deficiency in service and unfair trade practice, the forum directed it to provide the compensation of Rs 47,500 to the victim.
As per the complainant, in pursuance to an advertisement published by Health Sanctuary in a newspaper regarding ‘3 days weight loss challenge’, she had paid `20,000 on October 9, 2014, as per the package availed by her. The amount was taken for five sittings of ‘lipo’ and five sittings of ‘vacuum’, and one sitting was given complementary.
Anuradha claimed the plan was to reduce the weight on the stomach area and for flattening of the tummy, which was also offered during her examination. Though she visited the centre as per the schedule, she did not notice any signs of flattening of the tummy area even after a month.
She was told there was no need of losing weight to flat the tummy. When she confronted the centre, no appropriate response or assurance was given, following which she approached the forum. Despite summons, no one appeared on behalf of Health Sanctuary, and it was proceeded ex-parte.
The forum stated though the advertisement clearly mentioned that 20-25cm and up to 4 kg could be lost through C-Lipolysis from abdomen, hips, thighs and arms, and that “losing weight is easy, fast and safe, without any side effect”, the complainant could not get the promised result after one month of her regular visits. Not even 1kg of weight was lost, stated the forum.
“The evidence shows the complainant was harassed on account of the conduct of Health Sanctuary, and, thus, has been found deficient in rendering services.”
