High court hands over probe against Mohali MLA to CBI

Raising eyebrows over the Punjab police's investigations into a murder case allegedly involving SAS Nagar MLA Balbir Singh Sidhu and his brother Amarjit Singh, the Punjab and Haryana high court on Monday handed over the investigation into the case to the Central Bureau of Investigation (CBI). Rattan Singh, resident of SAS Nagar, was allegedly murdered in December 2010.

Justice Paramjit Singh said senior superintendent of police, SAS Nagar, had failed to abide by his undertaking before the court that the special investigating team (SIT) constituted to probe the case would do fair investigation. The bench also dismissed the bail petition of one of the accused, Kulwant Singh (sarpanch of Bariyali), who was accused of firing the gun shot which hit Rattan Singh in his head.

The firing incident on December 18, 2010 had left Rattan Singh dead and other four persons, including the petitioner, injured. Kulwant Singh, his brother Dilawar Singh, Kharar MLA Balbir Singh Sidhu's brother Amarjit Singh and two unknown persons were accused of murder in the FIR. Sidhu, the then Kharar MLA, was also booked by the police on charges of criminal conspiracy.

The bone of contention behind the murder was a long drawn litigation pertaining to land and filing of a case challenging the appointment of Kulwant Singh as sarpanch.

The high court directions came while disposing of a petition filed by victim's son Harjinder Singh, a resident of Balongi in SAS Nagar, seeking protection, fearing threat from Sidhu and his brother and also for handing over the investigation to the CBI. The petitioner had informed the court that he was being forced to enter into a compromise with Sidhu and his brother.

Appearing for the petitioner, advocate Charanjit Singh Bakshi submitted that since Sidhu was an influential person, he was manoeuvering investigation and the police were not arresting the real accused named in the FIR registered on December 19, 2010 at Balongi police station.

Bakshi argued that since the MLA's brother was one of the murderers and the murder had been planned, conspired and abetted by MLA Balbir Singh Sidhu himself, the police had taken no action in the case.
