The Himachal Pradesh high court on Wednesday asked the government to apprise it about the provisions under which the state government allowed illegal and unauthorised construction in the state.
A division bench comprising chief justice Kurian Joseph and justice Dharam Chand Chaudhary passed the directive on a writ petition filed by one Divya B Lal and others against the Shimla municipal corporation over ongoing illegal construction in the state capital.
The petitioners submitted that the state government had indicated about bringing the retention policy and one Kaushal was raising illegal and unauthorised construction and wanted the advantage of the said policy by constructing additional floor in the premises he had purchased.
The HC directed principal secretary, town and country planning to file an affidavit as to what were the enabling provisions to the government to pass the order for regularisation of unauthorised or illegal construction and whether there were any guidelines in this regard.
The court asked as to how many such illegal constructions had been regularised in the past ten years. The guidelines, if any, shall be produced along with the affidavit within three weeks.
