The complainant in the Harpreet Kaur case, Kamaljit Singh has moved Punjab and Haryana high court against Patiala special CBI court's judgment on the ground that the court had erred in not convicting the deceased's mother and Bholath MLA Bibi Jagir Kaur on charges of murder despite clearcut evidence.

The petitioner submitted before a bench headed by justice AK Mittal on Friday that on the basis of evidence of approver Dr Balwinder Singh, Jagir Kaur should be convicted for 'honour killing'.

Jagir Kaur was sentenced to five years in jail by the special CBI court in Patiala on March 30 for abduction and forcible abortion of Harpreet but acquitted her of charges of murder. Since then, she is lodged in Kapurthala jail.

The case was registered on the statement of Kamaljit Singh of Begowal village that he had married Harpreet secretly and she was pregnant with their child which was not acceptable to Bibi Jagir Kaur, ultimately resulting in her abduction and death.

The court was apprised that charges were also framed on the basis of evidence of the approver that Harpreet Kaur had died due to the conspiracy of her mother Jagir Kaur who felt that Harpreet's relation with Kamaljit were an embarrassment for her and never appreciated it.

Harpreet was cremated on April 20, 2000, without a post-mortem after her death under mysterious circumstances. Jagir Kaur had claimed that Harpreet died of food poisoning. Later, a case was registered on the statement of Kamaljit about the role of Jagir Kaur in Harpreet's abduction and death.

After hearing the case, the bench clubbed the case with Jagir Kaur's petition for bail and would now come up for hearing on August 21.
