For failing to refund the advance money given to book a venue for marriage reception even after cancellation of license of the marriage palace, the district consumer disputes redresssal forum, SAS Nagar, directed it to pay `10,000 as compensation for deficient services and unfair trade practices.
Disposing of a complaint filed by Dilbagh Singh, a resident of Sector 45, the Burail consumer forum directed the marriage palace, Libra Orchid Farms, SAS Nagar, to refund `25,000 paid as advance with 9% interest amount from November 2013 till the actual payment.
Dilbagh said that he had booked the palace for his nephew's marriage for reception that was scheduled to be held on February 14, 2014, in November 2013. The complainant alleged that while booking and taking advance, Libra Orchid Farms had withheld the vital information from him that the license for running the marriage palace had been cancelled by the Punjab government on account of misuse of the premises.
In order to get the true picture, Dilbagh then approached the authorities through an RTI and got the information that the license of the marriage palace, which was issued by GMADA, had been cancelled. Therefore, under the compelling circumstances, the complainant had to book another venue to hold the reception.
The complainant came to know about this in the first week of February 2014, and when he sought refund of the deposited advance money, he was denied refund.
He was also forced to book another marriage palace owing to which he had to spend extra money on transportation and to reprint the invitation cards reprinted.
Libra Orchid Farms was proceed ex parte as none appeared on its behalf.
The consumer forum presided over by Madhu P Singh on January 29, held, "It has been found that Libra Orchid Farms indulged in unfair trade practice by not disclosing the factum of license of marriage palace, having been cancelled by the authorities concerned way back in 2012. And it still is in the illegal business of running the marriage palace. It also received advance against the booking of marriage palace for February 15, 2014, and non-refund of the amount so deposited is an act of unfair trade practice and deficiency in service."
