Mentally challenged minor identifies 'rapist'

A 14-year-old mentally challenged rape victim, who is also affected by polio, identified her violator and with sign language told the court the gory tale of her sexual exploitation and then forcible termination of pregnancy.

The victim, along with her mother, told the court of additional district and sessions judge Shalini S Nagpal on Friday how the accused, who was her neighbour, sexually exploited her for nearly a year and later his kin forced her to undergo abortion at a private clinic which left her bleeding profusely for nearly a day till she got proper medical aid.

The victim's mother, a resident of Sector 56, had lodged the complaint on February 23, alleging rape of her daughter by their neighbour Vijay alias Vicky. The police had booked Vijay, his sister Sunita, mother Shanti, along with SAS Nagar-based doctor Rashmi Jain, who had terminated the five-month-old pregnancy without the consent of her parents.

The victim's mother, who works as domestic help, came to know about her daughter's pregnancy in February when she took her to a doctor as she was keeping unwell. Sunita accompanied them for check-up at Rashmi's clinic where they were told them that the victim was pregnant.

The complainant said it was then the victim, who is studying in Class 4 in a government school, told her that Vicky raped her for the past about a year. She the approached Vicky's family, who threatened her.

The complaint said Sunita and Shanti on February 21 took the victim to Rashmi's clinic and got her pregnancy terminated.

After returning from work, the victim's mother found her daughter bleeding and rushed her to civil hospital at Phase 6 in SAS Nagar, where the doctors revealed that the girl had undergone an abortion and the police was informed, as the victim was minor.

The police arrested the accused and raided Rashmi's clinic to find a blank form. The police claimed that the doctor without taking the consent of the victim's parents and to make money had terminated the pregnancy.

Not the first

In April 2012, 10-year jail was awarded to nine employees of Ashreya and Nari Neketan accused of raping a 16-year-old mentally challenged inmate of Ashreya, who was found pregnant. The victim not only identified the accused but also testified against them.

In November 2006, a differently abled minor victim through sign language testified against her violator and identified him. The court had awarded 10-year jail the accused Badal of Bapu Dham colony.
