'On the eve of selection board, adverse remarks expunged in ACRs'

The outgoing Deputy Judge Advocate General (DJAG) of Western Command Brig Dinkar Adeeb has raised the contentious issue of promotion of Brig T Parshad, DJAG of Central Command, to the rank of major general by expunging the adverse remarks in his annual confidential reports (ACRs) on the eve of the selection board meeting.

The outgoing Deputy Judge Advocate General (DJAG) of Western Command Brig Dinkar Adeeb has raised the contentious issue of promotion of Brig T Parshad, DJAG of Central Command, to the rank of major general by expunging the adverse remarks in his annual confidential reports (ACRs) on the eve of the selection board meeting.

Adeeb, who has been transferred to Eastern Command, filed a petition before the Chandigarh Bench of the Armed Forces Tribunal (AFT) on Wednesday on which notice was issued to the Army for July 31.

Parshad would take over as major general on August 1 and is likely to be posted as Judge Advocate General (top law officer) of the Army.

Earlier, there was only one vacancy for the rank of major general in the JAG branch. However, the government on May 4, 2012, created an additional vacancy of the rank of major general. And this time there were four brigadiers of the 1981 batch who were eligible to be promoted to these two vacancies.

But the government decided to conduct the selection board meeting for one post only in September 2012, which could not be held.

Thereafter, it was notified that the selection board for two vacancies would be held during the Army Commanders' conference on October 18, 2012.

While the four officers were to be considered on the basis of their existing record and comparative merit, junior-most officer Parshad was granted relief in his ACRs on the eve of the selection board. It was then postponed for October 19, 2012. With the improved ACRs, Parshad was selected as major general. Along with him, Major General (at that time brigadier) N Khanna was considered.

Adeeb submitted before the court that granting relief to an officer (Parshad) on the eve of the selection board meeting, and that too by postponing it repeatedly raised eyebrows as it was not only "unprecedented but also unethical and uncalled for" since it shifted the "goal-posts of the selection process" just immediately before the said process thereby granting an undue advantage to a particular officer.

He said the officer was granted relief out of turn on his statutory complaint whereas the Army follows 'first in, first out' in settling complaints of the officers. Adeeb has prayed for setting aside the recommendations of the selection board.

Capt Sandeep Bansal (retd), counsel for the Army, stated that the allegations (of Adeeb) were baseless and the petition was sketchy. He said the statutory complaint of Adeeb on the same issue was already cancelled.
