The CAT made this observation while dismissing the application filed by Prof CS Gautam and Dr Kanchan Kapoor, who had challenged their removal as heads of pharmacology and anatomy departments, respectively, of GMCH-32 on February 19, 2015. Prof Gautam was appointed the HoD in 2008, while Dr Kapoor was heading the department since 2010.
However, CAT gave the doctors liberty to move a representation to MCI either for relaxation in the eligibility conditions or to declare their qualification as equivalent to a medical degree.
UT administration through GMCH director Prof Atul Sachdeva had stated that they could not have allowed the applicants to continue as HoDs after MCI pointed out the violation of rules.
