Realty firm MD gets 2-yr jail for ignoring consumer court orders

The managing director of a realty-developing firm, Sumesh Chawla, has been awarded two years in jail by the Chandigarh district consumer disputes redressal for non-compliance of orders. The forum has issued non-bailable warrants against Chawla, who was also fined `10,000, for November 5 for his arrest to undergo the jail term.

Chawla, managing director of Chandigarh Overseas Private Limited, was in August last year directed by the forum to refund `4.75 lakh along with 9% interest to Sona Sharma, a resident of Zirakpur, who had exercised her buyback option for a 125 sq feet workspace in the firm's project Fashion Technology Park in Sector 90 of SAS Nagar. The firm is promoted by a group of developers and Greenfield Sites Management Private Limited.

As Chandigarh Overseas failed to comply with the orders, Sharma filed an order execution petition. Despite summons, Chawla failed to appear.

"Chawla's absence without any justification leaves us with no alternative but to believe that it does not wish to comply with the orders of the consumer forum…..It has been 18 months now since the orders were passed… and non compliance of the orders amounts to willful disobedience," reads the order of the consumer forum, presided over by Rajan Dewan, dated October 14.
