Granting interim relief to Maharwal Khewaji Trust, additional district and sessions judge RK Yadav on Thursday stayed the operation of the order, declaring the will of the Maharaja of Faridkot, Sir Harinder Singh Brar, which made the trust caretaker of the property, as forged.
The court allowed the prayer of the trust to grant stay on the operation of the order dated July 25 passed by chief judicial magistrate, Chandigarh. This implies that the trust would manage the properties till September 27, when the case will come up for hearing.
The court has allowed the trust to withdraw Rs 50 lakh from the bank accounts to meet its expenses for which it would have to submit the details of expenditure to the court.
The directions were issued on the appeal filed by the trust challenging the CJM order.
The trust that runs a charitable hospital had sought the stay to pay the salaries of the staff along with buying medicines. Besides, the trust had maintained that it was contesting a number of legal cases and was required to pay the fees of lawyers and needed money to maintain the property, which would not be possible in case the operation of the order was not stayed.
The trust had informed the court that its monthly expenditure was around Rs 40 lakh.
