Rs 50,000 fine slapped on lab for wrong report

The District Consumer Disputes Redressal Forum has penalised Dr Lal Pathlabs and directed it to pay a compensation of Rs 50,000 to the complainant for mental and physical harassment caused to him on account of deficiency in service.

The complainant, Karan Sharma, a resident of Sector 7, Chandigarh, who was undergoing treatment for certain pain in his right palm was advised to get a tissue transglutaminase test conducted.

The complainant visited the lab in Sector 16, here on July 24, 2012. The report was generated the next day on whose basis the complainant was advised to stop wheat intake. The complainant was advised that his test results were not positive and he had to undergo numerous other tests, which created panic and caused harassment to him.

The complainant then decided to undergo the same test from another lab whose result was a drastically different from what Dr Lal Pathlabs had shown. The complainant, however, did not stop here and went ahead to repeat the test from various other labs and was shocked that none of the results matched with the one given by Dr Lal Pathlabs.

Dr Lal Pathlabs did not turn up for the hearing and was proceeded against ex parte. The forum observed that the complainant had proved his case by leading documentary evidence as well as by filing duly sworn affidavit in support of his assertions. The forum pronounced the order on March13.
