Ruchika molestation case: HC questions ‘locus standi’ of petitioner NGO

The Punjab and Haryana high court on Thursday questioned the ‘locus standi’ (legal standing before a court) of the petitioner NGO world human rights council, which had sought an independent probe in Ruchika molestation case from day one involving former Haryana DGP SPS Rathore, for filing the petition in the case. The case came up for hearing before the division bench headed by justice SS Saron.

During the arguments of the case, appearing of Rathore, his cousel as well as wife, raised various objections on the maintainability of the public interest litigation filed by the NGO. On this, the bench asked the petititioner NGO about its antecedents, its source of funding, address and about the bank accounts, to which the chairman of the NGO advocate Ranjan Lakhanpal could not give a convincing reply and sought some time from the court to submit the details. On this the bench adjourned the case for May 3.

The bench also directed the Chandigarh administration to file the action taken report with proper affidavit on the magisterial enquiry report into the expulsion of Ruchika Girhotra from Sacred Heart School, sector-26 in 1990.

Rathore has been granted bail by the Supreme Court on November 11, 2010, after spending close to six months in Burail jail while serving sentence of 18 months for molesting Ruchika, a 14-year-old budding tennis player in August 1990. Later Ruchika had committed suicide by consuming poison.
