Security firm to pay Rs 1 lakh penalty for theft

The district consumer disputes redressal forum, SAS Nagar, has directed a security firm to pay Rs 1 lakh as compensation to the owner of a car showroom in Phase 6, where a theft of Rs 5.54 lakh had taken place in April 2012, in spite of the company providing its services.

After the theft, Goel Motors Private Limited, the authorised dealer of Mahindra and Mahindra company, had moved the consumer forum alleging deficiency in services on the part of Phase 6 -based Omni Security Services, being run by Lt Colonel Madhu Berry.

On Friday, the consumer forum disposed of the case with the president Madhu P Singh, saying, “The security agency failed to provide honest and diligent security guards to the complainant. It is the duty of the security agency to verify the antecedents and credentials of its employees before putting them on duty of security to the premises of the complainant. The agency has certainly miserably failed to do so.

Therefore, for the acts of omission and commission the security firm cannot be absolved of their vicarious liability.” The company has been asked to pay Rs 5.54 lakh with 12% interest from August 9, 2012, the date of the theft, till the actual realisation.
