Slap sodomy, rape charges on accused: Prosecution

After the CFSL report pointed out that the 20-year-old Sector 22-based eatery owner’s daughter, who had died of drug overdose in October last year, was raped and sodomised before death, prosecution has moved an application for invoking sodomy and rape charges against accused in the case. The prosecution has also sought DNA profiling of the accused.

After the CFSL report pointed out that the 20-year-old Sector 22-based eatery owner’s daughter, who had died of drug overdose in October last year, was raped and sodomised before death, prosecution has moved an application for invoking sodomy and rape charges against accused in the case. The prosecution has also sought DNA profiling of the accused.

The application was moved during a resumed hearing of the death case of the 20-year-old woman, a student of architecture at a Sector-34 institute, in which three persons - Rajat, a Sector 51 resident and a student of evening college at Panjab University (PU), Kamal, who runs a dhaba at Sector 37-D, and Dilpreet, studying interior designing, - are facing trial under Section 304 (culpable homicide not amounting to murder) of the IPC.

In the application moved before the court of additional district and sessions judge Anshu Shukla, the prosecution has relied on the Central Forensic Science Laboratory (CFSL) report to urge the court for addition of rape and sodomy charges.

The case would now come up for hearing on July 27 when counsel of Rajat and Kamal would be filing a reply. “We have given no objection to invoking more sections. Dilpreet and the deceased had been in a relationship and had even stayed together,” said advocate Terminder Singh, who is defense counsel of accused Dilpreet.

The CFSL report placed on record on June 6 stated that the victim was sodomised before death as human semen was detected during forensic examination, while brain haemorrhage (intracranial haemorrhage) was termed as reason for victim’s death.


FATHER, BROTHER HAD IDENTIFIED ACCUSED

Testifying before the court, victim’s father and brother had identified the accused before the court.

The court had already dismissed the application, seeking murder charges against the accused, of victim’s father and stated that Dilpreet used to threaten her.
