The 20-year-old daughter of an eatery owner, who had died of drug overdose in October last year, was sexually assaulted before her death as per the findings of forensic experts.
This revelation was made by the CFSL report that was placed on record before the court of additional district and sessions judge Anshu Shukla on Saturday during the resumed hearing of the mysterious death of the girl, who was pursuing a course in architecture from a Sector-34 institute.
The CFSL report stated that brain haemorrhage (intracranial haemorrhage) was the cause of the death of the victim. The development has raised many an eyebrow on the police investigations as the UT police had filed a challan against the three accused for a lighter offence — ‘culpable homicide not amounting to murder’ (Section 304 of the IPC). The accused in the case are: Rajat, a resident of Sector 51 and a student of the evening college at Panjab University; Kamal who runs a dhaba in Sector 37D and Dilpreet, a student of interior designing.
“The development hints at callous investigations by the police. The report was placed on record by the investigating officer who should ideally had moved an application for amending charge or filed a supplementary chargesheet against the accused, booking them for sexual assault,” said Munish Dewan, the counsel of the victim’s father.
“This is a new aspect which has appeared. The case is before the court so now the future course of action would be as per the directions of the court,” said UT inspector general of police RK Upadhyaya.
THE CASE SO FAR
The body of the victim, who was pursuing a course in architecture from a Sector-34 institute, was found in a drain on the Rajpura Road near Shambhu barrier in Haryana on October 21 last year.
During the investigation, the police zeroed in on her friend Rajat Beniwal, 21, who told the police that he, along with victim, Kamal and Dilpreet were consuming heroin inside his car in SAS Nagar, when the victim died apparently due to drug overdose. He had also stated that the victim was in a relationship with Dilpreet.
The police claimed that accused Rajat, Kamal and Dilpreet panicked finding the victim dead and dumped the body in a drain.
Her body was later recovered after Rajat identified the place where the body had been dumped. Kamal was arrested from his residence in Sector 56 and Dilpreet from Phase 10 in SAS Nagar. Testifying before the court, the father and brother of the victim have already identified the accused before the court. The court had dismissed the application of the father of the victim, seeking slapping of murder charge against the accused.
