A local court on Monday acquitted a 22-year-old, youth arrested by the police on allegations of rape after the prosecution failed to prove them.
A 22-year-old labourer Vikas Kumar alias Chintu, who hails from Bihar and used to stay with his sister in Mundi Kharar, was arrested by the police on complaint of his neighbour.
A resident of Mundi Kharar employed as gardener with UT horticulture department had lodged a complaint with police on May 16, 2011 where he had accused Vikas of kidnapping and raping his minor daughter on pretext of marrying her. Police had arrested Vikas about 45 days later and even recovered the girl.
Vikas had contested the allegations saying that he had an affair with the girl and they had married against family wishes thus the father of the girl had leveled false allegations against him.
"The prosecution's case fell flat when the girl's was proved to be 18 years old on basis of medical examination and she had gone with the boy of her own will," said defence counsel Avinash Sharma.
The defence counsel also proved in the court that the Vikas and the girl had already married and for about 45 days when the girl stayed with the Vikas and traveled to various cities she never raised the alarm thus proving the allegations to be false.
