"One can very well imagine the plight of a minor boy of nine years age when he was being subjected to such a heinous act by the accused. He must have been trembling with fear during that time," the judge added. The prosecution had alleged that on February 26, 2011, the accused had kidnapped the minor boy and had sodomised him. The prosecution said the victim, a Class 4 student, was returning from his friend's house after borrowing a copy to write down notes, when he was forcibly dragged to a deserted area in a park and sodomised.

The accused had denied the charges of kidnapping and sodomising a minor boy and had claimed trial.

The counsel for the accused had told the court that his client was implicated in the case for slapping the alleged victim once for pelting a stone on his sister.

The court, however, brushed aside the contention saying "I find the testimony of the victim absolutely credible and trustworthy."
