The AIIMS has been asked by the Central Administrative Tribunal (CAT) to take administrative decisions in accordance with regulations in order to avert anomalous situation.
"We do not want such a prestigious institution to suffer unnecessarily in administrative matters for lack of implementation in accordance with the (AIIMS) Act and the Regulations," the Tribunal comprising members Veena Chhotray and Shanker Raju said.
The CAT made the observations allowing appeals filed by P S Chawla and other technical assistants against a government memorandum terminating their ad hoc appointments as technical officers and scrapping the draft recruitment rules.
The petitioners sought framing of recruitment rules and consequent consideration for promotion to the post of technical officer.
The Tribunal did not find the reversion of petitioners from "ad hoc officiation of technical officers" as justified since it held the draft rules advocating higher qualification for the post not valid.
"We have to balance the equation in a manner that their rights is protected but also interests of others should not be prejudiced and the only way we have found is that now we direct AIIMS to notify the rules in accordance with the Act without affecting the earlier promotions in the cadre of Technical Officer," it said, restoring their ad hoc promotions as technical officers with all consequences.
