Bank fined Rs. 1.64 lakh for bullying customer

Terming it as a "case of unsolicited issue of credit card", a consumer court has ordered a private bank to pay a compensation of R1.64 lakh to a west Delhi resident, who was bullied for recovery of Rs. 60,000 that was not even due from him.
"…The complainant needs to be compensated for the harassment he has undergone at the hands of the appellant bank (ICICI)," the Delhi State Consumer Disputes Redressal Commission said, upholding an order of a district consumer forum that had awarded Rs. 1.64 lakh compensation to the complainant.
"It is clear that the credit cards were supplied without asking the complainant and the appellant bank resorted to the practice of threats and bullying for recovery of an amount which was not only based on a false claim, but was unwarranted, unjustified and impermissible under the law," a bench of commission president Justice Barkat Ali Zaidi and member Salma Noor said, dismissing the bank's plea.
Complainant Rohit Sharma, a resident of Ramesh Nagar in west Delhi, had alleged that though he never applied for any credit card, the bank had issued three cards in his name on the basis of forged and false documents and was harassing him to pay more than R60,000 spent on the credit cards.
Sharma alleged that the bank issued the credit cards in his name, on his application at 'his' Noida address, whereas he is residing at Ramesh Nagar since childhood.
The bank, however, contended that Sharma was denying the existence of the credit cards to avoid making payments.
The bank denied having made any threatening calls or using abusive language or sending musclemen to recover the amount due from Sharma.
