CBI says Subba’s birth certificate fake

Congress MP from Assam MK Subba, whose Indian citizenship is questioned, has been alleged that he is a Nepalese citizen. Bhadra Sinha reports.

Congress MP from Assam MK Subba, whose Indian citizenship has been questioned, is in trouble as the CBI has found his birth certificate to be fake.

A three-judge Supreme Court bench headed by Chief Justice KG Balakrishnan on Monday said the Congress leader’s certificate with the Election Commission is allegedly fake and that according to the CBI, he submitted false documents and baseless information in his affidavit to the Commission.

The sealed cover report, given to the bench in December last, was perused in open court. Without revealing its full contents, the bench said: “The birth certificate produced by Subba is not genuine. The report is against you.”

The agency’s probe report is in response to a petition questioning Subba’s citizenship. The petitioner, Noida resident Birendra Nath Singh, has alleged the lottery baron is a Nepalese citizen.

However, his birth certificate with the EC mentions Silliguri in West Bengal as his birthplace. Singh has also alleged that the Lok Sabha MP came to India after a murder case was registered against him in Nepal in the 1970s.

Subba has been asked to respond to the CBI report. His counsel Abhishek Manu Singhvi sought a copy of the report that was allowed by the court.

The CBI submitted its report in December 10, 2007, 10 months after the SC directed it to probe the allegations raised in the petition.

Subba has already denied the allegations. He claims he was born in Dadgram village in Darjeeling district and his parents migrated from Singtam village in Sikkim. As per court orders, he had in April last year submitted several documents to prove his Indian citizenship.

One of those documents was his birth certificate. The CBI later carried out its probe to verify the documents submitted by Subba.
