The Delhi High Court on Friday asked two accused in the Commonwealth Games scam to respond to the plea of the CBI seeking cancellation of their bail on the ground that they absconded for over six months during the probe.

Justice Mukta Gupta issued notices to accused Purushottam Dev Arya and Anil Kumar, both businessmen, and fixed the matter for further hearing on May 24. The duo are accused along with Kalmadi and seven others for their alleged role in the award of a contract for installation of timing, scoring and result system for the Games to a Swiss firm, the Swiss Timing Omega.

The CBI in its petition said they did not deserve to be out on bail on the ground of parity as they absconded for over six month during the probe in the case. During the hearing, CBI prosecutor Dayan Krishnan said the trial court should not have granted bail to them on the ground of parity as it was against the provisions of law.

Besides the graft case, the businessmen duo have been made accused in a case registered later for allegedly evading the process of law.
