Additional District Judge Reetesh Singh said, “It is an admitted case that the offending vehicle owned by Delhi Jal Board (DJB) was not insured. So, DJB alone would be liable to pay the compensation”.

Ashok Arora, 48, owner of an aluminum kitchen utensils manufacturing firm, was mowed down by the DJB vehicle near Loni border in north-east Delhi on November 17, 2008.

He was on way to his factory at Karawal Nagar on his motor bike when the accident took place. Following the accident, he was rushed to Guru Teg Bahadur hospital, where he died during the course of treatment.

The court ordered DJB to pay Rs 25,51,102 as compensation to the wife, parents and two children of deceased Ashok Arora, assessing his annual income at Rs 2,29,193 at the time of his death.

“Accordingly, an award for the sum of Rs 25,51,102 is passed in favour of the petitioners (family members of the deceased) and against the driver of the offending vehicle, to be borne by DJB,” the judge added.

A DJB employee, Sanjeev Kumar, also faced a departmental inquiry for causing the accident due to his rash driving, the court pointed out.
