In yet another setback to veteran Congress leader ND Tiwari in a paternity suit, the Supreme Court on Tuesday directed him to give his blood sample for a DNA test.
“Enough is enough, you were not present on earlier occasions. Having regard for your age, we told you to give the sample in a sealed cover. We gave you protection under Article 21, but enough is enough,” said a bench of Justice Aftab Alam and Justice CK Prasad.
“Give the blood sample and ventilate yourself. What’s the problem?” the court asked Tiwari's counsel.
The court’s direction came while it was hearing Tiwari's appeal, challenging a Delhi high court order, dated December 23, 2010, to subject himself to a DNA test.
His counsel said, “No one would be safe in this country if such DNA tests are allowed. Tomorrow, anybody can make allegations against an important person and seek such a test just to humiliate him.”
The bench had not relented and, instead, reiterated that Tiwari will have to undergo the test.
It, however, agreed to look into the question of law raised in Tiwari’s appeal, which contended that he cannot be forced to provide a blood sample for a DNA test in a civil suit.
