Friend sole witness in rape case

A BPO employee who was lucky enough to escape the clutches of the five men, who gangraped her friend and colleague in Dhaula Kuan area of south Delhi, is the only “live witness” in the chargesheet filed by the police in the case on Wednesday.

A BPO employee who was lucky enough to escape the clutches of the five men, who gangraped her friend and colleague in Dhaula Kuan area of south Delhi, is the only “live witness” in the chargesheet filed by the police in the case on Wednesday.

Police said they took legal opinion from various experts before submitting the chargesheet at the Dwarka court on Wednesday to make a “foolproof case” against the accused.

Delhi Police on Wednesday filed a chargesheet in the Dhaula Kuan gangrape reported in November last year, police said. The chargesheet that runs into 65 pages names 59 witnesses, including the victim’s friend.

“We submitted the 65-page chargesheet in the court on Wednesday. The victim’s friend is one of the main witnesses who saw the accused bundle her friend into a pick up van and later gangraped her,” said HGS Dhaliwal, deputy commissioner of police (south).

Police said they have attached the reports of DNA profiling and the ballistic report of the weapon used in the commission of crime as part of evidence against the accused.

The incident took place on November 24, when the victim who was returning home after work with her friend. She was pulled by the five accused and bundled into a pick up van and gangraped. The victim was then dumped in the Mongolpuri industrial area from where she called the police and was rescued.

The five accused — Shamshad alias Khutkan, Usman alias Kale, Shahid alias Choti Billi, Kamruddin alias Mobile and Iqbal alias Bada Billi — are all friends and hail from the same village of Mewat region in Haryana.

“The most important evidence we have in the case is that the victim identified them during the test identification parade (TIP) even though they had shaved their heads to confuse her. The DNA samples lifted from the scene of crime and CCTV footage procured from five locations, where the vehicle passed through are also key evidences,” said a senior police officer.

Police said the mattress used in the crime was burnt by them the same night they fled from Mongolpuri area after dumping the victim. During interrogation, police had studied 105 similar cases reported from in and around Delhi. The country- made pistol was recovered from the house of Usman alias Kale at Mirpur village near Faridabad a few days later. The accused had used this weapon to threaten the victim.
