The government won’t reveal inquiry findings into former Chief Justice of India and National Human Rights Commission chief KG Balakrishnan’s alleged misconduct and wealth details of his relatives.
The home ministry informed RTI activist Subhash Chandra Aggarwal that no action was required after examining the finance ministry’s report.
“Complaint of misconduct and immovable properties acquired by the kith and kin of Justice KG Balakrishnan was received by the ministry and it was referred to the finance ministry. The inquiry report received from there and Supreme Court were examined in consultation with the law ministry,” the home ministry said.
“It was decided that no ground/case is made out for seeking a Presidential reference to the Supreme Court under the law to ask for the removal of NHRC chief since the allegations do not pertain to any misbehavior during his tenure as the commission’s chairperson. However, as the inquiry report on the allegations was secret, the said report/file notings cannot be provided,” the ministry stated.
The ministry also said there were“no complaint or any adverse media report” against Justice Balakrishnan when he was appointed NHRC chief.
Former CJIs Justice RC Lahoti and Justice YK Sabharwal were both eligible for the same post.
Justice Lahoti declined the position and Justice Sabharwal was not offered due to adverse media reports, but there is no official record about either of them.
