Petitioners Anita Mehrotra and Supriya Saha, teaching in the Department of Philosophy as temporary lecturers, said they had been appointed in 2006 by a regular selection committee and hence they are eligible for permanent posting.

Their lawyer O.P. Saxena claimed before a vacation bench of Justice Sunil Gaur a selection board meeting on May 30, 2008, rejected their names for regularization and recommended names of two new candidates who “are not even PhDs in philosophy for appointment as lecturers on regular basis”. Mehrotra and Saha claimed they had experiences of 12 and eight years respectively.

Justice Gaur made it clear that any fresh appointment made would be subject to the outcome of the writ petition. “The selection committee is clearly indulging in favoritism and the Head of Department has been promoting their own favourites for appointments on regular basis even though they are not qualified”, the petition contended.
