HC rejects plea against Escorts

The Delhi High Court on Thursday dismissed Anil Nanda’s petition seeking to quash Escorts Heart Institute and Research Centre governing body’s decision to convert the public trust hospital into a company.

The Delhi High Court on Thursday dismissed Anil Nanda’s petition seeking to quash Escorts Heart Institute and Research Centre governing body’s decision to convert the public trust hospital into a company.

Justice B.D. Ahmed rejected the plea of Anil, younger brother of Escorts chairman Rajan Nanda, on the ground that he did not seek court permission before filing the suit.

Anil had filed the suit in 2005 against Rajan after Escorts was converted into a company. He alleged Rajan had appropriated funds of EHIRC, Delhi by forming another society in Chandigarh and amalgamating them before converting it into a company.

“Plaintiffs are required to have obtained leave of the court before instituting present suit. The requirement is not a mere formality but mandatory,” said Justice Ahmed.
