The hearing on the revision petition filed by Dr Nupur Talwar at the Allahabad high court against the CBI court's orders issued on February 9 at Ghaziabad in the Aarushi-Hemraj double murder case, will continue on Monday.
Nupur's counsel Samit Gopal told the Hindustan Times that no decision could be arrived on Friday and the court has decided to continue the hearing on Monday.
On February 9, special judicial magistrate (SJM) Priti Singh, while concluding the hearing on the Central Bureau of Investigation's (CBI) final report, had issued orders for issuance of summons against Dr Rajesh and Nupur Talwar under sections 302 (murder), 201 (destruction of evidence) and 34 (acts done by several persons in furtherance of common intention) in the double murder case.
The SJM's orders came after the CBI had filed a final report on December 29, 2010, but the court exercised its judicial powers and found sufficient material in the final report to bring the dentist couple to face a possible trial and issued orders for summons.
On February 21, Nupur Talwar moved the high court in a revision petition against the SJM's orders and requested further investigation into the case.
At the Ghaziabad court, during the hearing on the final report, CBI counsels had maintained that there was no scope for further investigation.
For now, the Talwars are have been ordered to appear before the Ghaziabad CBI SJM court on February 28, as per the normal course of law, while a possible decision on Nupur's revision petition is still pending at the high court on the same date.
Fourteen-year-old Aarushi Talwar and the Talwars’ domestic help Hemraj Banjade were found murdered on May 16 and 17, 2008, respectively, at the Talwars' Jalvayu Vihar residence in Noida.
