A Delhi court has awarded the dumper truck, which caused the death of a daily-wage labourer, to his family as compensation. The accident had taken place in May 2012.
“The family of Surinder Kumar, 26, has slumped into economic crisis after his death, and the commercial operations of the vehicle may help it secure livelihood,” the court observed.
Motor Accident Claims Tribunal judge Rekha Kumari noted that the dumper truck involved in the accident was not covered by insurance. Therefore, the victim’s family could not be compensated from an insurance company.
The court directed the vehicle’s owner and driver to compensate the family. One Chandra Pal, the truck’s owner, told the court that he had mediated with the victim’s family and requested them to take the truck as he was suffering losses in business. The judge endorsed the mediation reached between them.
Upender Singh, the counsel for Kumar’s family, told the court that the vehicle will be insured once it was handed over to the family and would be used for commercial purposes. The money generated will be equally split between Kumar’s wife and his parents, said the counsel.
