A man has been sentenced to five years rigorous imprisonment by a Delhi court for raping his minor neighbour for nearly four months after taking her to various places in Uttar Pradesh.
Additional Sessions Judge J R Aryan also imposed a fine of Rs 2,000 on convict Sampat Kumar, hailing from south Delhi, after holding him guilty of rape and kidnapping.
The court acquitted two others, accused of abetting in the commission of offence, for want of evidence.
The accused, who attempted to take advantage of the statements of the girl that she willingly accompanied him, could not get any relief from the court which said "consent of a minor is no consent in the eyes of law."
"A grown-up person would have given a consideration to the fact that the girl was minor and was not capable to take her own decisions. It appears the accused has taken advantage of the situation," it said, discarding the girl's statement.
An FIR was lodged by the father of the girl, a VIIIth standard student, on November 13, 2006 at Sarita Vihar police station after she did not return home from school.
The needle of suspicion turned to the accused who was also missing. On March 19, next year, he was arrested from a place in UP and the victim was found.
Later, the girl testified that she willingly went with the accused. The court, however, rejected it saying minor's consent could not be accepted.
