A Delhi court on Wednesday awarded death penalty to a man for raping and killing a five-year-old daughter of his neighbour, saying the offence fell under the "rarest of rare category" as it was "diabolical and ghastly".
"In order to understand the ghastliness of the offence, it is necessary to understand how painful the process of death would have become for the minor victim when convict had forced her to drown in muddy water of a pond," Additional Sessions Judge Vinod Kumar said.
Sending the convict to gallows, the court said as per the medical reports, the victim died an extremely painful death.
It rejected the plea that the convict be awarded life sentence saying the probability of him getting transformed was bleak and allowing such a person to exist was dangerous to the society.
In a case that hinged on circumstantial evidence, the court said the chain of events was complete as the victim was last seen with the accused by her father and later and the recovery of her dead body at the instance of the accused proved the case.
"The entire sequence shows that within a few hours of the victim being last seen with the accused, her body was found raped and killed," it said.
The time between the offence and the accused being seen with the victim left little doubt that it was the accused who did the henious act, it said.
Accused Ranjeet, a neighbour of the victim who used to live at Gopalpur village in north Delhi, took the minor girl to a secluded place on the evening of July 3, 2007 and raped her before drowning her in the muddy water of a pond.
