A Delhi court has issued a notice to a woman, who was awarded compensation and a monthly maintenance of Rs 3,000 under the Domestic Violence Act, on an appeal by a man claiming she was not his wife.
"Notice of this appeal and interim stay application is issued against the respondent (the woman). It be served to her through the protection officer also for May 10, 2010," Additional Sessions Judge J R Aryan said.
The man, who rubbished the claim of the woman that she was married to him, filed an appeal against the order of a Metropolitan Magistrate which had asked him to pay Rs 30,000 compensation besides a monthly maintenance of Rs 3,000 to her under the Protection of Women from Domestic Violence Act.
The lower court, in its order, had said even if the woman is not married and is living with a man, she becomes entitled to claim of compensation and maintenance under the Act.
The man, a private secretary to a director of Chemical and Fertiliser Ministry, said the woman was a widow of a government servant and he had only offered some help to her.
"The order of the lower court is illegal and bad in law as I am no way concerned and related to the woman in question," the appeal said.
On the other hand, the woman had claimed that their marriage was solemnised in 1988 and now her husband was harassing her, forcing her to file a case under the Domestic Violence Act.
The court has fixed the matter for further hearing on May 10.
