Original CD’s of BMW sting operation played in court

A Bench comprising Justices Manmohan Sarin and SK Mishra had in the morning allowed Khan’s counsel to inspect and watch the original CD after the court hour.

The original CDs of the BMW sting operation done by a TV channel purportedly showing senior advocates RK Anand and IU Khan influencing the controversial witness Sunil Kulkarni were played in the courtroom after it was alleged that one of the CDs had discrepancies.

The CD was played for Khan after the court hours in the presence of the Joint Registrar of the Court and only the representatives of amicus curiae and the TV channel were allowed inside.

A Bench comprising Justices Manmohan Sarin and SK Mishra had in the morning allowed Khan’s counsel to inspect and watch the original CD after the Court hour.

The Bench passed the order on Khan’s plea, who submitted he wanted to inspect the original CD before filing response in the contempt case against him in BMW expose case. The Court, however, made it clear it would not extend the time given to him to file reply and he had to do it by Monday.

The expose by the channel had purportedly shown Public Prosecutor IU Khan and defence counsel RK Anand trying to influence Kulkarni to give a testimony in favour of accused Sanjeev Nanda.

In a sting operation telecast in May, NDTV had claimed to expose a nexus between Khan and Anand to influence Kulkarni.

On May 31, the court had taken suo motu cognisance and later notice was issued to the senior advocates. Holding that there was prima facie case against them, the Court had initiated contempt proceeding against Anand and Khan.
