The CBI has alleged that A Raja misled the Prime Minister and suppressed facts from him on the spectrum allocation issue.
The chargesheet states that on November 2, 2007, Raja wrote a letter to the PM “misrepresenting facts and fraudulently justifying” his decision regarding the cut-off date of September 25, 2007 for applications for the UAS license. Raja justified this saying that on this date the announcement of cut-off date appeared in newspapers. But the chargesheet says probe revealed Raja was in criminal conspiracy with other co-accused before the publication of cut-off date in newspapers.
He also misled the PM saying the opinion of the law ministry on sending the matter of deciding upon the procedure to allocate license and spectrum to an empowered group of ministers is out of context. The chargesheet says the PM sent him a letter on the same day. It says Raja sent another letter to the PM in the night even before his earlier letter could reach the PMO. Raja’s former additional private secretary A Achary told a magistrate he typed the letter dictated by Raja.
Apart from Achary, there are seven other witnesses who have recorded their statements. These are deputy director general (DoT), AK Srivastava, joint wireless advisor Ramjee Singh Kushvaha, former wireless advisor RP Agarwal, group CEO of Ambit Holdings Pvt Ltd Ashok Wadwah, general manager of Reliance Infrastructure Ltd Ashish Karyekar and Deodutt Pandit, whose profession is not listed.
