A man who had parked his car in a Metro station's parking lot was awarded Rs. 50,000 as compensation by a district consumer forum after someone had tried to break into it.
A private contractor who was managing the parking lot was asked to pay damages.
He had to pay for the damage and the theft. CK Chaturvedi, president of a District Consumer Disputes Redressal Forum awarded the Rohini resident, Praveen Kumar Singh, Rs. 40,000 for irresponsible service and Rs. 10,000 for litigation expenses.
In October 2008, Singh had parked his car in the Moti Nagar Metro station's parking lot which has been licensed by the Delhi Metro Rail Corporation (DMRC) to a private contractor, Raj Kumar Khanna & Sons.
After being given a parking slip, Singh left the keys of his car with the parking attendant. When he returned, the glass of the rear window of his car was broken and his leather bag, containing important papers, documents, keys etc. were missing.
Since the keys were collected by the parking attendant, the consumer court said, "…the responsibility of goods also passes on to the attendant and he cannot wriggle out."
The damage was done to the car when it was in custody of Opposite Party No 2 (Raj Kumar Khanna & Sons), the court added. The court studied the question of propriety analysed the contract between the DMRC and the private contractor.
DMRC in its reply agreed that according to the terms of contract, the private contractor was liable for any damage to or theft to the property, the amount can be recovered from the its security deposit.
