The Supreme Court on Monday sought the Union and Maharashtra governments' response on a PIL seeking a CBI probe into the alleged misuse of funds donated to the Hind Swaraj Trust, an NGO run by social activist Anna Hazare.

The petition was filed by advocate Manohar Lal Sharma, who said the Centre had allotted funds to the trust in 1995 even before it got registered with the Council for Advancement of People’s Action and Rural Technology (CAPART) — a government funding agency and a party to the case.

Sharma, who accused Hazare of misusing the funds, has also made the CBI a respondent in the case. The NGO, Sharma said, received R65.85 lakh from the Maharashtra government for 1995-96. It also received R75 lakh in 1995 from CAPART, although it didn’t have the required three years’ experience.

Placing the Justice Sawant Commission’s report on the alleged misappropriation of funds, Sharma said, “The above facts have been admitted by the accused persons before the Sawant Commission in 2004.”

Sharma also claimed in the petition that the CAPART had released R5crore to the trust for rural health projects. “The true amount of what has been exploited from the consolidated fund will be discovered only if a proper probe is conducted.”
