SC seeks CBI response on Talwars' petition

The Supreme Court on Friday asked the CBI to respond to dentist couple Rajesh and Nupur Talwars' petition that challenged a Ghaziabad court's order summoning them as accused in connection with murder of their teenage daughter Aarushi and domestic help Hemraj.

The Supreme Court on Friday asked the CBI to respond to dentist couple Rajesh and Nupur Talwars' petition that challenged a Ghaziabad court's order summoning them as accused in connection with murder of their teenage daughter Aarushi and domestic help Hemraj.

The Talwars approached Supreme Court in March after the Allahabad high court refused to stay the proceedings before a CBI court in Ghaziabad, which had also issued bailable warrants to them.

A Supreme Court bench headed by justice B Sudershan Reddy posted the matter to April 25 after additional solicitor general PP Malhotra said the CBI would file its response within a week.

On behalf of the dentist couple senior counsel Harish Salve said the trial court's order needed to be quashed.

The apex court, had on March 19, stayed all the proceedings relating to the summoning of the Talwar couple and of the bailable warrants issued against them by a Ghaziabad court.

But the bench had asked the couple to surrender their passports before the trial court.

The Allahabad high court had on March 18 dismissed their petition for quashing of the proceedings initiated by the lower court.

While refusing the CBI's closure report, the trial court had summoned the Talwars as accused in the case.

The high court said it could not prohibit the magistrate from taking cognisance of a case if prima facie it appeared that there was sufficient evidence against a person.

Fourteen-year-old Aarushi was found murdered at the Talwars' Noida house on May 16, 2008. The very next day, Hemraj's body was recovered from the terrace of the house.
