Super Bazaar stay order vacated

Accepting the plea of a private firm which is managing the ailing shopping co-operative Super Bazaar, the Delhi high court on Tuesday vacated its single judge’s order which had stayed the firm’s notice asking nearly 1,000 employees not to report to duty.

Accepting the plea of a private firm which is managing the ailing shopping co-operative Super Bazaar, the Delhi high court on Tuesday vacated its single judge’s order which had stayed the firm’s notice asking nearly 1,000 employees not to report to duty.

A bench comprising chief justice D Murugesan and justice Rajiv Sahai Endlaw said that the “stay order was passed without any reason” and allowed the appeal of Writers and Publishers Ltd against the single judge bench order.

“....Ordinarily, no interim stay against termination is granted in as much as upon the challengers showing the termination to be bad, direction for payment of full back wages and consequential benefits can always be granted,” the bench said and asked the managing firm and Super Bazar Karamchari Hitesh Sangathan to approach the single judge for early disposal of the case.
