A Delhi court sentenced two men to 10 years in prison for kidnapping and gangraping a physically challenged girl in 2010.
Additional sessions judge Mahesh Chander Gupta, who is chairing one of the special fast track courts for trial in cases of sexual offence against women, convicted Sunil and Sanjeev Kumar.
The judge relied on the testimony of the victim, who stated that she was kidnapped from outside her house in Prahlad Vihar and then raped at an isolated location on January 25, 2010.
Later, one of the accused gagged her and took her to a nearby room, which was bolted by the third accused, a juvenile, from outside.
Meanwhile, accused Sanjeev and Sunil raped the girl, the police said, adding when she raised an alarm, her relatives opened the door and rescued her.
The judge said, “The testimony of the prosecutrix and analysis is found to be clear, natural, cogent, convincing, trustworthy and inspires confidence. In spite of incisive cross-examination, nothing material has been brought out on the record so as to impeach her creditworthiness.”
The judge also imposed a fine of Rs.16,000 on each accused.
Relying on the testimony of the victim, the judge said, “In the witness box, she (victim) withstood the test of cross-examination and her testimony was consistent throughout.”
During the trial, Sanjeev and Sunil claimed they have been implicated in the case. The juvenile, who was also arrested in the case, is facing a trial before the Juvenile Justice Board.
