Parents of Utsav Sharma, 29, who attacked Dr Rajesh Talwar inside the Ghaziabad court complex on Tuesday with a meat cleaver, moved his bail application at a Ghaziabad chief judicial magistrate (CJM) court on Monday.

Sharma is presently facing attempt to murder charges (section 307 of IPC) and also charges under provisions of 7 Criminal Law Amendment Act after he was arrested in connection with assault on Talwar last Tuesday.

“In our bail application we have stated that our client is suffering from ‘bipolar disorder’ and has been wrongly booked under section 307 IPC. His attack was not with the intention to murder but just to cause injury,” Sharma’s advocate SP Chaudhary said.

Meanwhile, Dasna prison officials also submitted a medical report to the Ghaziabad court.

“We submitted our report to the court and stated that his behaviour is indifferent to surroundings and is avoiding questions and conversations,” Dasna prison superintendent, Viresh Raj Sharma said.

“On the basis of his past treatment record of three years and our observations, we think he should be referred to the mental hospital at Varanasi where other UP prisoners are kept,” Sharma added.
